Terms of Service

By accessing or using TOURIBO (available at touribo.com and touribo.ai), you agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you and Oceanic Consulting VOF ("TOURIBO", "we", "us", "our"). If you do not agree to these Terms, you must not use TOURIBO. If you are using TOURIBO on behalf of an organization, you represent that you have authority to bind that organization to these Terms. These Terms should be read in conjunction with our Privacy Policy, which is incorporated by reference.

TOURIBO is an AI-powered travel planning platform that helps users create personalized trip itineraries. Our services include: CORE FEATURES - AI-generated travel itineraries using large language models - Interactive trip maps with activity markers - Day-by-day itinerary organization and editing - Trip sharing and collaboration features - Travel assistant chat functionality - Health and activity scoring tools SUBSCRIPTION PLANS - Free Plan: Up to 3 trips, standard AI generation, core features - Pro Plan: Unlimited trips, priority generation, all features, export tools - Enterprise/B2B: API access, white-label options, dedicated support API ACCESS (B2B) - Programmatic access to itinerary generation - Places and travel time APIs - Rate limits and usage quotas apply per plan We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where feasible.

REGISTRATION - You must provide accurate, complete, and current information when creating an account - You must be at least 16 years old to create an account (in accordance with GDPR Article 8) - One person may not maintain more than one account without our prior written consent - You are responsible for maintaining the confidentiality of your password ACCOUNT SECURITY - You are responsible for all activity that occurs under your account - You must immediately notify us of any unauthorized use at [email protected] - We are not liable for losses resulting from unauthorized account use due to your negligence - You should use a strong, unique password and enable any available security features ACCOUNT TERMINATION BY YOU - You may delete your account at any time via Dashboard settings - Account deletion is immediate and cascades to all associated trip data - Certain data may be retained as required by law (see Privacy Policy) GOOGLE OAUTH - You may sign in using Google OAuth - We receive only your name, email address, and profile picture from Google - Your Google account is governed separately by Google's Terms of Service

FREE PLAN - Maximum 3 saved trips - Access to all core planning features - Standard AI model routing - No payment required - No time limit PRO PLAN - Unlimited saved trips - Priority AI generation - All current and future Pro features - PDF/calendar export tools - Price: €12/month (subject to change with 30 days notice) - Billing: Monthly, cancellable at any time PAYMENT - Payments processed by third-party payment processors (not by TOURIBO directly) - We do not store payment card details - Subscriptions renew automatically unless cancelled before the renewal date - Refunds are handled on a case-by-case basis — contact [email protected] PLAN CHANGES - Upgrades take effect immediately - Downgrades take effect at the end of the current billing period - If you downgrade from Pro to Free and have more than 3 trips, existing trips remain accessible but new trip creation is blocked until you are within the free limit B2B/API PLANS - Custom pricing based on usage volume - Contact us at [email protected] for enterprise inquiries - API keys are non-transferable and must not be shared publicly

You agree to use TOURIBO only for lawful purposes and in accordance with these Terms. YOU MUST NOT: - Use the service for any illegal purpose or in violation of any local, national, or international law - Attempt to gain unauthorized access to any part of TOURIBO's systems or infrastructure - Use automated tools, bots, or scrapers to access the service beyond the permitted API - Reverse engineer, decompile, or attempt to extract source code - Share your account credentials or API keys with unauthorized parties - Attempt to circumvent rate limits, trip limits, or other service restrictions - Use the service to generate content that is harmful, misleading, or fraudulent - Impersonate any person, organization, or entity - Submit false, inaccurate, or misleading trip or personal information - Use the service in a way that could damage, disable, or impair our systems - Resell or sublicense access to the service without written permission CONSEQUENCES Violations may result in immediate suspension or termination of your account without notice or refund. We reserve the right to report illegal activity to relevant authorities.

NATURE OF AI CONTENT TOURIBO uses large language models (including Anthropic Claude and Google Gemini) to generate travel itineraries. By using these features, you acknowledge: - AI-generated itineraries are suggestions only, not professional travel advice - We do not guarantee the accuracy, completeness, or currency of generated content - Opening hours, prices, availability, visa requirements, and travel times may be inaccurate - AI models can and do make mistakes ("hallucinations") - Generated content reflects training data which may be outdated YOUR RESPONSIBILITY - Always verify critical travel information independently before booking or travel - Check current visa requirements, travel advisories, and health requirements with official sources - Confirm opening hours and booking requirements directly with venues - Do not rely solely on TOURIBO for safety-critical travel decisions DATA SENT TO AI PROVIDERS - Trip parameters (cities, dates, interests) are sent to AI providers to generate itineraries - No personally identifiable information is sent to AI providers - AI providers process this data under their own terms and our data processing agreements - See our Privacy Policy (Section 5) for details on AI sub-processors INTELLECTUAL PROPERTY OF AI OUTPUT - Generated itineraries are provided to you for personal use - We do not claim copyright over AI-generated itineraries - You may export and use your generated itineraries freely

TOURIBO'S INTELLECTUAL PROPERTY - The TOURIBO name, logo, branding, and visual design are owned by Oceanic Consulting VOF - The platform's source code, architecture, and non-AI-generated content are our proprietary property - All rights not expressly granted herein are reserved YOUR CONTENT - Trip data, notes, and itineraries you create remain your property - By saving content on TOURIBO, you grant us a limited license to store, display, and process that content for the purpose of providing the service - We do not claim ownership of your trip data - You can export and delete your data at any time USER-GENERATED CONTENT - If you share trips publicly or with other users, you grant those users a right to view that content - You are responsible for ensuring any content you submit does not infringe third-party rights FEEDBACK - If you provide feedback, suggestions, or ideas about TOURIBO, you grant us a perpetual, royalty-free license to use that feedback to improve the service without obligation to you

TO THE MAXIMUM EXTENT PERMITTED BY DUTCH AND EU LAW: DISCLAIMER OF WARRANTIES The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. LIMITATION OF LIABILITY Oceanic Consulting VOF shall not be liable for: - Any indirect, incidental, special, consequential, or punitive damages - Loss of profits, data, goodwill, or other intangible losses - Travel disruptions, cancellations, or losses arising from reliance on AI-generated content - Third-party service failures (airlines, hotels, Google Maps, etc.) - Unauthorized access to your account resulting from your own negligence - Service interruptions, downtime, or data loss MAXIMUM LIABILITY Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or €50, whichever is greater. CONSUMER RIGHTS Nothing in these Terms limits your statutory consumer rights under Dutch or EU law, including rights under the Dutch Civil Code (Burgerlijk Wetboek) and EU consumer protection directives.

You agree to indemnify, defend, and hold harmless Oceanic Consulting VOF and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: - Your use of the service in violation of these Terms - Your violation of any applicable law or regulation - Your infringement of any third-party rights - Any content you submit to the service that causes harm to a third party - Your sharing of trip content that infringes third-party intellectual property We reserve the right to assume exclusive control of any matter subject to indemnification, at your expense. You agree to cooperate with our defense of such claims.

TERMINATION BY YOU You may stop using TOURIBO at any time. To delete your account and all associated data, use "Delete My Account" in Dashboard settings. TERMINATION BY US We may suspend or terminate your access to TOURIBO immediately and without notice if: - You breach these Terms - We are required to do so by law - You engage in fraudulent, abusive, or illegal conduct - Continued access would cause harm to us, other users, or third parties EFFECT OF TERMINATION Upon termination: - Your right to access and use TOURIBO ceases immediately - We will delete your personal data in accordance with our Privacy Policy - Pro subscription fees already paid are non-refundable unless required by law - Sections on Limitation of Liability, Indemnification, and Governing Law survive termination ACCOUNT REACTIVATION We are not obligated to reactivate terminated accounts. GOVERNING LAW These Terms are governed by the laws of the Netherlands, specifically the Dutch Civil Code (Burgerlijk Wetboek), without regard to conflict of law principles. EU CONSUMER LAW If you are a consumer resident in the EU, you also benefit from the mandatory protections of consumer law in your country of residence. DISPUTE RESOLUTION Before initiating formal proceedings, we encourage you to contact us at [email protected] to resolve disputes informally. We will make reasonable efforts to address your concerns within 30 days. FORMAL PROCEEDINGS If informal resolution fails: - Disputes shall be submitted to the competent court in Rotterdam, the Netherlands - Consumer residents in the EU may also use the EU Online Dispute Resolution platform at: ec.europa.eu/consumers/odr/ - The Dutch Consumer Authority (ACM) may also be contacted for consumer disputes CLASS ACTION WAIVER To the extent permitted by applicable law, you waive any right to bring claims as a plaintiff or class member in any class action or representative proceeding.

We may update these Terms of Service from time to time as our service evolves or as required by law. NOTIFICATION OF CHANGES When we make material changes: - We will update the "Last Updated" date at the top of this page - We will notify registered users by email at least 14 days before changes take effect - We will display a prominent notice on the website - For changes that materially affect your rights, we will seek fresh consent where required by law NON-MATERIAL CHANGES Minor changes (such as typo corrections, clarifications that don't affect your rights) may be made without prior notice. CONTINUED USE Your continued use of TOURIBO after updated Terms take effect constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the service and may delete your account. ARCHIVED VERSIONS Previous versions of these Terms are available upon request by emailing [email protected].

ENTIRE AGREEMENT These Terms, together with the Privacy Policy, constitute the entire agreement between you and Oceanic Consulting VOF regarding your use of TOURIBO. SEVERABILITY If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. WAIVER Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. ASSIGNMENT You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction. FORCE MAJEURE We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet outages, or government actions. LANGUAGE These Terms are written in English. In case of any conflict between a translation and the English original, the English version prevails.
